Enforcement Provisions Include Revoking Shipping Access
if NWIW Breaches Agreement

Kalama WA – Today, the Port of Kalama Commission voted to amend its dock usage agreement with NW Innovation Works (NWIW) to further ensure and clarify that methanol produced in its Kalama facility is used exclusively for materials production.  The amendment sets clear parameters binding NWIW to its commitment that methanol produced at its Kalama facility be sold for use in materials production; providing the Port the right to audit and inspect NWIW shipments and records in order to enforce the agreement; and imposing penalties, including losing access to the dock and, thereby preventing the shipment of NWIW methanol, if the agreement is violated.

“From the first day we signed our lease with the Port of Kalama we have always said that the product from NWIW Kalama was focused on and intended for the materials market,” said Vee Godley, Chief Development Officer for NWIW. “The Port of Kalama’s action today provides further certainty that our intent is carried out. Our mission is to provide global leadership at an industrial scale to produce the world’s cleanest methanol in order to make everyday materials a part of the global climate solution.”

“This agreement, including its limitations and penalties, is definitive. It’s a high bar, and we support it. NWIW will need to prove that the methanol leaving here will be dedicated to materials production. If we can’t, the methanol doesn’t leave, and our right to use the dock faces revocation,” said Kent Caputo, General Counsel for NWIW. “This action clarifies and assures that NWIW meets its mission of providing global leadership at an industrial scale to produce the world’s cleanest methanol to make everyday materials a part of the global climate solution.”
